On May 17, 2010, the U.S. Supreme Court decided, in Graham v. Florida, that sentencing a juvenile offender to life imprisonment without parole constitutes cruel and unusual punishment under the Eighth Amendment. Graham was charged as a adult for attempted robbery at the age of 16. This charge carried the maximum penalty of life imprisonment without the possibility of parole.
