Attorneys representing Transocean filed for protection from lawsuits based on 150-year-old maritime law. Although actual recovery could reach tens of billions of dollars, Transocean believes this law caps their liability at slightly under $27 million. Largest Oil Spill in U.S. History

The 1989 Exxon Valdez disaster spilled approximately 11 million gallons of oil off the coast of Alaska. However, BP's Oil Spill has now surpassed the Exxon Valdez disaster by nearly 6 million gallons -- with probably 17 million gallons spilled in the Gulf of Mexico. Despite the latest "Top Kill" measure, the situation is progressively worsening. Why? What's the solution? Who or what should be solving the problem? Is it the U.S. federal government? Does the BP Gulf Oil Spill constitute a national emergency?

According to Robert Reich, President Obama does not have the legal authority to direct BP's actions in the Gulf. Can the president declare a national emergency pursuant to the National Emergencies Act (50 U.S.C. 1601-1651)? A national emergency has only been invoked once during this presidential term, and that was on October 24, 2009 for the swine flu?
