State of Virginia v. Federal Department of Health and Human Services

The State of Virginia has filed a case in federal court challenging the constitutionality of the Patient Protection and Affordable Care Act. The State disagrees with the Obama Administration's position that the Commerce Clause and the Necessary and Proper Clause empowers the federal government to regulate and tax a citizen's decision not to participate interstate commerce, i.e. buy private health insurance. The federal judge, Henry Hudson, refused the Administration motion to dismiss the case which will proceed in federal court. The judge's memorandum opinion is here.
